Privacy Policy

1. Introduction
This document outlines the Data Privacy Compliance Policy of SAINT MICHAEL GUARD
WATCH SECURITY SERVICES INC. (“the Agency”), in adherence to Republic Act No.
10173, also known as the Data Privacy Act of 2012 (“DPA”), and its Implementing Rules and
Regulations (“IRR”). The Agency is committed to protecting the personal data of its applicants,
employees, clients, and customers while ensuring data processing activities are lawful,
transparent, and secure.

2. Scope
This policy applies to all personal data collected, processed, and retained by the Agency from the
following stakeholders:
 Job applicants and employees.
 Customers availing of security services.
 Other third parties, including suppliers and contractors, where applicable.

3. Definition of Terms
 Personal Data: Any information, whether recorded in a material form or not, from which
the identity of an individual is apparent or can be reasonably and directly ascertained.
 Data Subject: An individual whose personal data is processed.
 Processing: Any operation performed upon personal data, including collection, storage,
use, sharing, and destruction.

4. Collection of Personal Data
The Agency collects personal data for the following purposes:
 For recruitment and employment purposes, including background checks and payroll
processing.
 For client account creation, service delivery, and contract management.
 For compliance with legal and regulatory requirements.
Examples of personal data collected include but are not limited to:
 Applicants and Employees: Full name, address, contact details, educational
background, work experience, government-issued IDs, and medical records.
 Customers: Full name, contact information, payment details, and service requirements.
 Other Parties: Names, contact details, and business information.

5. Legal Basis for Processing
The Agency ensures that all personal data is processed based on any of the following lawful
criteria:
 Consent from the data subject.
 Fulfillment of a contractual obligation.
 Compliance with a legal obligation.
 Legitimate interest, provided it does not override the fundamental rights and freedoms of
the data subject.

6. Data Subject Rights
The Agency upholds the following rights of data subjects:
 Right to Be Informed: Data subjects have the right to know how their data is collected,
used, stored, and shared.
 Right to Access: Data subjects can request access to their personal data held by the
Agency.
 Right to Correction: Data subjects can request rectification of inaccurate or incomplete
data.
 Right to Erasure: Data subjects may request the deletion of their data when no longer
necessary.
 Right to Data Portability: Data subjects may obtain their data in a structured format for
transfer to another data controller.
 Right to Object: Data subjects can object to the processing of their data in specific
circumstances.

7. Data Protection Measures
The Agency implements robust security measures to protect personal data, including but not
limited to:
 Administrative safeguards, such as employee training and access controls.
 Physical safeguards, such as secure storage of documents.
 Technical safeguards, such as firewalls, encryption, and secure networks.
In the event of a data breach, the Agency will notify affected data subjects and the National
Privacy Commission (NPC) within the prescribed timeframe.

8. Retention and Disposal
The Agency retains personal data only for as long as necessary to fulfill the purpose for which it
was collected or to comply with legal requirements. Upon expiration of the retention period, the
Agency securely disposes of records through methods such as shredding, deletion, or
anonymization. Applicant’s personal data including the 201 file will be retained for 2 years after
the employee has exited the company.

9. Third-Party Sharing
The Agency may share personal data with third parties, such as government agencies, service
providers, or partners, under strict confidentiality agreements and only for legitimate purposes.
Data sharing is subject to prior consent from the data subject unless otherwise required by law.

10. Policy Updates
This policy may be updated periodically to reflect changes in laws, regulations, or operational
practices. Data subjects will be notified of significant updates.

11. Complaints and Inquiries
Data subjects may direct complaints, concerns, or inquiries about the processing of their personal
data to the DPO. If unresolved, they may escalate concerns to the NPC.
